    Position Description: You will have at least 6+ years of experience in benefits and have experience working with complex plan documents/contracts. You will work on specialist projects that are aligned to benefits, and partner to create internal communications for anything related to Total Rewards. The ideal candidate enjoys working with teams of people, process improvement, and supporting a positive employee experience. Some key skills needed are the ability to influence others, clearly communicate, project manage, and work well with all levels. You will report to the Manager of Total Rewards Experience and be able to work some days in the office and some days remotely.

    In a dispute involving the Affordable Care Act's (ACA's) preventive health services rules, a Texas district court held that the coverage mandate for preexposure prophylaxis (PrEP) drugs to prevent HIV infections violated an employer's rights under the Religious Freedom Restoration Act of 1993 (RFRA).     On July 26, 2022, the Department of Health and Human Services (HHS) re-proposed its implementing regulations under Section 1557 of the Affordable Care Act (ACA), which prohibits discrimination on the basis of race, color, national origin, sex, age, or disability in certain health programs and activities. The July 2022 re-proposed regulations would reinstate certain requirements from the May 2016 final regulations (issued under the Obama administration), including provisions that define discrimination on the basis of sex to include discrimination based on gender identity.

    The White House has issued an executive order addressing actions the administration will take regarding reproductive health care services in response to the Supreme Court's recent Dobbs ruling on abortion. Among other topics, the order calls for additional administrative guidance on covered contraceptives and privacy considerations under the Health Insurance Portability and Accountability Act (HIPAA).

    In a dispute involving long-term disability (LTD) benefits, a district court in South Dakota held that the Department of Labor's (DOL's) safe harbor for voluntary benefits applied regarding an employee's individual LTD policy. As a result, the LTD policy was not covered by the Employee Retirement Income Security Act of 1974 (ERISA) and the employee's state-law claims (which included bad faith and breach of contract) were not ERISA-preempted.

    In a dispute involving long-term disability benefits under a plan governed by the Employee Retirement Income Security Act of 1974 (ERISA), the US Court of Appeals for the Second Circuit concluded that a benefit determination on administrative review under the Department of Labor's (DOL) claims regulations must decide with finality whether a claimant is entitled to benefits. The court rejected the insurer's argument that the DOL's regulations afforded the insurer flexibility and additional time to remand the matter for further internal consideration.
